The long awaited reform of Canada’s Trademarks Act is now scheduled to be in place by early 2019. The planned reform includes the following changes pertaining to Canadian trademarks: elimination of “use” as a requirement for registration; implementation of the Madrid Protocol; implementation of the Nice Classification System; introduction of filing fees based on the number of classes of goods/services included in an application; allowing applications for additional non-traditional marks such as scents, tastes, holograms, and moving images; and, introduction of divisional applications.
